What’s the criteria to expedite vets’ Social Security disability?

People in Wayne and across the state who are returning from military service, or have relatives doing the same, will often have concerns if there were injuries or illness suffered while in combat. This can be an injury, a physical illness or a mental illness. The Social Security Administration is responding to public need by expediting the process through which Social Security disability benefits will be awarded. For those with 100% permanent and total disability, there are certain factors that must be in place to receive the expedited approval.

Those who have served in the military are subject to a large number of problems that can arise. They can be physically wounded or mentally affected by what they have experienced. The SSA is cognizant of the issues faced by Wounded Warriors and their families. In March 2014, veterans who receive a rating or 100 percent P&T can have their approval sped up. If the Veterans’ Administration deems a claimant 100 percent disabled that doesn’t automatically mean that the SSA will approve benefits. There are certain criteria that must be met for the SSA to provide benefits.

The claimant must be unable to perform substantial work due to the medical issues and these issues must have lasted or be expected to last for at least 12 months or end with the claimant’s death. The application can be completed online, the claimant can call the SSA or visit a local Social Security office. It is necessary to make an appointment before going in person. To receive expedited processing, the claimant must let the SSA know that the veteran has been rated 100 percent P&T. A notification letter verifying that there is this designation must be provided to the SSA.

The speed of the process depends on the disability or disabilities the veteran suffers from, how soon the medical evidence is provided and if it is required to visit another medical professional to accrue evidence of the P&T nature of the disability.

The process can be made easier with legal assistance, which this blog post cannot provide. Those who are suffering from the aftereffects of military service might not be capable of dealing with all the details of receiving benefits. Speaking to a qualified legal professional can be helpful to make the process easier.
