I can draft a simple will where you will state as to who will receive your assets. Young parents with no assets need a will just as much as people with a lot of assets because it is important that they state as to who will take care of their children should they pass away. Young parents who die in an automobile accident or plane crash could leave a very large estate or lot of money to their children which would cause a lot of caring and uncaring people to want to take care of your children. It is important to draft a will so that caring people will raise your children.

Power of Attorney and Medical Power of Attorney

It is important to give a person the power to make medical or financial decisions on your behalf if you should become incapacitated to do so. It is imperative that you have a medical power of attorney because in Michigan if you should get in an accident and are conscious but incapable of talking, paralyzed and only kept alive by machines or feeding tubes the courts have held that you must be kept alive.

Probate

If someone has died Robert D. Paulbeck can transfer the assets from the decedent's estate to the beneficiaries. The only assets that are required to be probated when a person dies are those assets that are in that person's name alone. All joint property or property that has a designated beneficiary is not subject to probate. For example, a house with a husband and wife on the title is not subject to probate because the property automatically passes from the decedent to the surviving spouse. When the surviving spouse dies then the house will have to be probated so that the house can be transferred to the decedent's heirs.
